Information about ACAT Fees

Please note: These fees came into effect on 1 July 2016. This information is a summary of the Court Procedures (Fees) Determination 2016 (No 3).

Payment of Fees

The correct fee must filed with your application. The ACAT accepts cash, bank cheque and credit card payments over the counter, and credit card, bank cheque or money order via post. We cannot accept payments by telephone or email.

To make a credit card payment via post, please complete the Credit Card Payment Authorisation form and forward it with your application to the ACAT at GPO Box 370 Canberra ACT 2601.

The ACAT Registry Counter is open for general enquiries between 9.00am and 4.30pm, each weekday. However, the Counter cannot accept payments after 4.00pm on any day.

Fees for Individuals (natural persons) and Corporations

Under the ACAT fee structure, corporations pay higher fees than individuals. However, if your corporation is a body that is incorporated as a not-for-profit corporation or had a turnover of less than $200,000 in the previous financial year, it will be charged fees at the same rate as those applying to a natural person. If your corporation falls into this category, you will need to complete a Statement As To Nature And Turnover Of A Corporation form and submit it with your application.

Fees may be waived, deferred, remitted or refunded in cases of financial hardship

If payment of fees will cause you hardship you may apply to ACAT Registrar for the fee to be waived or deferred, remitted or refunded. An application will only be approved in special circumstances. For consideration to be given to your circumstances, you will need to complete and lodge with the ACAT the Request about Payment of Fees Form. Please refer to our fee waiver and deferral policy.

Exemptions from paying ACAT fees

From 19 May 2016, you are exempt from paying ACAT fees if you are named on a Commonwealth-issued Health Care Card, Low Income Health Care Card or Pensioner Concession Card.

You are also exempt if you are being represented in your ACAT matter by the Aboriginal Legal Services (NSW/ACT) Ltd, Canberra Community Law Ltd, including Street Law, the Women's Legal Centre (ACT & Region) Inc. or Legal Aid.

To claim your exemption, you will need to show your health care or concession card, legal assistance letter or Notice of Representation from the legal services mentioned above, and complete a Request for Exemption from Paying Fees for ACT Courts or ACAT Matter.

Notes about hearing fees:

Daily hearing fees are payable for the hearing of any case that is set down for more than one day, and for which an application fee was chargeable (even if it was waived).

  • Hearing fees do not apply for cases that do not have an application fee.
  • The amount of the fee varies depending on how many days the matter will take.
  • The hearing fee is to be paid by the applicant unless the ACAT orders otherwise.
  • The hearing fee must be paid within 7 days of the ACAT setting the hearing dates.
  • Additional daily fees are payable for each day that the hearing goes beyond the estimate.
  • These fees must be paid by the earlier of (a) when the ACAT allocates the extra hearing days or (b) at the end of the hearing.
  • If the case is settled or adjourned 28 days or more before the hearing dates, 75% of the fee is refundable.
  • If the case is settled or adjourned 14 days or more before the hearing date, 50% of the fee is refundable.

Fees paid for a hearing that is adjourned can be transferred to the new hearing dates.

Inspections   and Searches

 

For an inspection or a search in relation to a record of a tribunal   (including a request to determine whether or not a named person is involved   in litigation, the viewing of material held by the tribunal, or a request to   determine whether information is held by the tribunal

$166.00 per hour of time in which a   registry staff is involved. The minimum charge is 10 minutes. An Estimate of   the fee must be paid prior to the search or inspection being undertaken.

Transcripts

For a supply of a disk containing a record of a proceeding or a part   of a proceeding or of a matter incidental to a proceeding.

$27.00 per DVD or CD-Rom. A minimum fee of $112.00 per transcript   applies when the total order does not exceed the minimum fee.

Provision of a transcript of proceedings where the request for the   transcript requires the preparation of the document

$5.45 per folio for same day delivery

$4.95 per folio for next business day delivery.

$3.85 per folio for delivery within 5 business days.

$3.80 per folio for delivery within 7 business days.

A minimum fee of $112.00 per transcript applies when the total order   does not exceed the minimum fee.
